Duration of Protection and Considerations for Enforcement

In the Philippines, the term of protection for a Utility Model is seven (7) years from the filing date.

Although this period is considerably shorter than the twenty (20)-year term of a Patent, the Utility Model system is intended to provide rapid protection for technical innovations. It is therefore particularly suitable for incremental improvements and technologies with relatively short product life cycles.

However, because Utility Models are generally registered without substantive examination, there are important considerations when enforcing Utility Model rights that differ from those applicable to Patents.

Term of Protection

A Philippine Utility Model is protected for seven (7) years from the filing date.

Unlike the Patent system, the Utility Model system does not provide for:

  • Annual maintenance fees
  • Renewal of the registration
  • Extension of the term of protection

Accordingly, a Utility Model automatically expires upon the completion of its seven-year term.

Commercial Consideration:

When developing an intellectual property strategy, applicants should carefully consider the expected commercial life of the product, the anticipated market launch schedule, and whether Patent or Utility Model protection would be more appropriate.

Rights Conferred by a Utility Model

The owner of a registered Utility Model has the exclusive right to exploit the protected invention. Without the authorization of the rights holder, third parties are generally prohibited from:

  • Manufacturing the protected product;
  • Using the protected invention;
  • Selling the protected product;
  • Offering the protected product for sale;
  • Importing the protected product; or
  • Possessing the protected product for commercial purposes.

A Utility Model is also an intellectual property asset and may therefore be licensed, assigned, transferred by inheritance, or used as security for financial transactions.

Important Considerations in Enforcing Utility Model Rights

Unlike Patents, Utility Models in the Philippines are generally registered without substantive examination. Accordingly, registration does not necessarily guarantee the validity of the registered Utility Model.

The validity of a registered Utility Model may be challenged if:

  • The invention lacks novelty;
  • The statutory requirements for registration have not been satisfied; or
  • The invention is substantially identical to prior art.

Risk Mitigation:

Before sending a cease-and-desist letter or commencing infringement proceedings, it is highly advisable to assess the validity of the registered Utility Model. A prior art search and legal assessment may significantly reduce enforcement risks.

Enforcement of Utility Model Rights

If unauthorized use of a Utility Model is identified, the following actions should be considered, depending on the circumstances:

  1. Investigating the technology and the allegedly infringing product;
  2. Confirming the scope of the registered claims;
  3. Conducting an additional prior art search;
  4. Collecting evidence of infringement;
  5. Sending a Cease and Desist Letter;
  6. Negotiating a licence agreement;
  7. Conducting settlement negotiations; and
  8. Considering administrative or judicial enforcement proceedings.

Licensing and Assignment

A Utility Model may be commercially exploited through licensing or assignment as part of an overall business strategy.

Typical examples include:

  • Manufacturing licences granted to Philippine companies;
  • Distribution or sales licences covering ASEAN markets;
  • Licences associated with joint development projects;
  • Technology transfer agreements; and
  • Assignments of Utility Model rights in connection with mergers and acquisitions (M&A).
