Philippine Industrial Design Renewal
An industrial design registration in the Philippines is not maintained automatically. To keep the registration in force, renewal fees must be paid to the Intellectual Property Office of the Philippines (IPOPHL) within the prescribed time limits.
Term of Protection
A registered industrial design is protected for an initial period of five (5) years from the filing date.
The registration may then be renewed for:
- First Renewal: Additional five (5) years
- Second Renewal: Additional five (5) years
Accordingly, the maximum term of protection is fifteen (15) years from the filing date.
Renewal Deadline & Grace Period
- Renewal Deadline: A renewal application should be filed before the expiration of the current registration period, together with payment of the prescribed official fees. Failure to renew on time may result in the registration lapsing and the loss of exclusive rights.
- Grace Period: If the renewal fee is not paid before the expiration date, Philippine law provides a six (6)-month grace period, subject to payment of the required surcharge.
Caution: If renewal is not completed within the grace period, the industrial design registration will lapse and cannot be maintained.
Requirements for Renewal
Generally, the following information is required:
- Registration number
- Name of the registered owner
- Payment of the prescribed official renewal fees
- Power of Attorney (if required in the particular case)
※Additional documents may be requested by IPOPHL depending on the circumstances.
