Filing Procedure & Timeline

Trademark applications in the Philippines are filed with the Intellectual Property Office of the Philippines (IPOPHL). Applications may be filed directly with IPOPHL or through the Madrid System for the International Registration of Marks.

The Trademark Registration Process

The typical trademark registration process consists of the following stages:

1. Filing of Application

The application is filed with IPOPHL together with the applicant’s details, a representation of the mark, and the specification of goods and/or services.

2. Formality Examination

IPOPHL reviews the application to ensure that all filing requirements and formalities have been satisfied.

3. Substantive Examination

The examiner assesses whether the mark is registrable, including issues such as distinctiveness, descriptiveness, conflict with prior trademarks, and compliance with applicable laws and regulations.

4. Publication and Opposition Period

If the application is accepted, it is published in the IPOPHL e-Gazette. Following publication, a 30-day opposition period is provided during which third parties may oppose the registration based on prior trademark rights, well-known marks, trade names, or other legal grounds.

5. Registration

If no opposition is filed, or if any opposition is successfully overcome, the trademark proceeds to registration and a Certificate of Registration is issued.

6. Declaration of Actual Use (DAU)

To maintain a trademark application and registration in the Philippines, the owner must comply with the Declaration of Actual Use (DAU) requirements prescribed by law.

Warning: Failure to comply may result in the abandonment of the application or cancellation of the registration.

Typical Timeline

The time required for registration varies depending on examination issues, office actions, oppositions, and other circumstances.

  • Straightforward Cases: In a case where no office action or opposition is encountered, registration is typically obtained within approximately 8 to 12 months from filing.
  • Complex Cases: More complex cases involving office actions, oppositions, appeals, or other disputes may require a substantially longer period.
